While striking an animal in the roadway may seem like an unavoidable hazard, my experience has shown me that these incidents often raise important questions that deserve further investigation. Instead of making assumptions, it’s important to ask the right questions to ensure that all possible contributing factors are explored. To that end, there are three critical questions that need to be considered.

First, did the authorities conduct a thorough investigation? When a large animal, such as a horse, is in the roadway, it’s important to determine how it got there. Did law enforcement investigate where the horse came from and whether it was properly contained? Did they identify the owner and determine if they were negligent in allowing the animal to roam freely? Additionally, did officers examine whether there were adequate warning signs or fencing in the area to prevent this kind of collision? The depth of the investigation will determine whether all responsible parties are held accountable.

Second, has anyone looked into whether a vehicle defect contributed to the crash? While striking an animal is an unpredictable event, a vehicle’s ability to respond to sudden hazards can sometimes be compromised by mechanical failures. Issues with braking, steering, or collision-avoidance systems could impact whether a driver has a chance to avoid impact.
