Any mention of alcohol is obviously serious, and if details confirm that alcohol led to this accident, the alleged drunk driver show face appropriate consequences. But that might not be the end of the story. In fact, there could be an accomplice to all of this who also should face consequences: a negligent alcohol provider. Let me explain.
Under Texas dram shop laws, bars, restaurants, and other alcohol providers have a legal responsibility not to over-serve alcohol to someone who is obviously intoxicated. When they fail to follow this law, they not only endanger the person they serve but also everyone else on the road. If the Mercedes-Benz driver was over-served before getting behind the wheel, the establishment that served them may share responsibility for this crash.
Holding negligent alcohol providers accountable under dram shop laws helps ensure that injured parties get the answers they deserve and sends a clear message to alcohol-serving establishments: follow the law or face the consequences. That accountability plays a key role in promoting public safety and reducing the risk of similar accidents in the future. Maybe that doesn’t apply to this specific accident, but there should be clear evidence to say one way or the other.
