Commentary by Attorney Michael Grossman

If the allegations here turn out to be true, then it’s just awful to see alcohol take yet another life on Texas roads. It’s all too common, yet I find still not everyone knows what can follow these kinds of accidents. They may understand that the allegedly drunk driver can have their day in court, but what about other factors? For example, was that person drinking at a bar or restaurant? Did the establishment illegally over-serve them? Did their service of alcohol to the driver contribute to the deadly accident? Are they in violation of criminal code or TABC guidelines? Are they subject to penalties, fines, or liability?

One of the reasons drunk driving is a problem is because few ever consider the full extent of the circumstances that can lead to a deadly wreck like this. A driver having their day in court is obviously important, but it may just be one potential factor. Could it be, then, that there’s more to this story, as well?
