Commentary by Attorney Michael Grossman

When I hear about a crash like this one, my first thought is to examine the circumstances surrounding the right-of-way. Intersections are inherently risky areas, and understanding which driver had the legal right to proceed is often key to determining liability.

One critical question is whether either driver failed to obey traffic controls at the intersection. Was there a traffic signal or stop sign, and if so, were they functioning correctly?

Another factor worth examining is the speed of the semi-truck. Large trucks require significantly more distance to stop than smaller vehicles, particularly when traveling at higher speeds. Investigators should review the Freightliner’s black box data to determine how fast it was traveling and whether the driver attempted to brake before the impact.

The visibility and layout of the intersection may also play a role. Were there clear sightlines for both vehicles approaching the intersection, or were there obstructions like trees, buildings or parked vehicles? Poor visibility could have prevented either driver from reacting in time to avoid the collision.

It’s also notable that authorities do not believe impairment was a factor, which places more emphasis on road conditions, driver attentiveness and compliance with traffic laws. Investigators should consider whether distractions, such as in-vehicle systems or external factors, may have contributed to the crash.

Ultimately, determining what caused this collision will require a thorough review of the actions of both drivers, the design and condition of the intersection and the mechanical state of the vehicles involved. Crashes like this highlight the importance of maintaining clear and safe intersections, especially where high-speed roadways intersect. By addressing these factors, we can work toward reducing the likelihood of similar incidents in the future.
