Commentary by Attorney Michael Grossman

There are a lot of factors not clear right now, but the reports of a commercial driver making a mistake are obviously concerning. As straight-forward as people may think things are when a truck driver makes a mistake, it’s important investigations extend beyond the scene to include that driver’s employer. Let me explain.

Any experienced trucker will attest to the fact there are companies out there that care as little about their own drivers as they do the general public. These companies demand drivers meet unrealistic deadlines, work long hours, drive in trucks that aren’t maintained properly, and otherwise meet expectations that create serious risks. As such, when a crash like this happens, it’s important to know if it was just an isolated mistake or the inevitable result of a negligent company reinforcing dangerous behavior.

Simply put, I’ve handled hundreds of commercial vehicle accident cases. I can’t remember the last time a serious truck wreck began and ended behind the wheel. Investigations should be thorough enough to both identify the direct cause of the crash as well as any potential series of events that led to that mistake. That way, steps can be taken to ensure there is accountability for all responsible parties.
