Commentary by Attorney Michael Grossman
When a motorcycle carrying two people leaves the roadway without any outside contact, the reasons behind the loss of control aren’t always easy to see. That’s why a complete investigation is so important.
Did the authorities thoroughly investigate the crash?
A motorcycle crash at highway speeds should be documented with precision—mapping the exact path, measuring any skid or scuff marks, and noting where control first appeared to be lost. Investigators should also consider the riders’ actions in the moments before the crash. The depth of that work depends on whether the team on scene has the training and tools to go beyond a basic report.
Has anyone looked into the possibility that a vehicle defect caused the crash?
Motorcycles can be affected by sudden mechanical problems like brake failure, steering lock, or tire blowouts. These issues may not be visible without a close inspection of the bike’s braking, steering, and suspension systems. If that step is skipped, a defect that contributed to the loss of control could remain undiscovered.
Has all the electronic data relating to the crash been collected?
While motorcycles don’t typically store as much data as passenger vehicles, some models have limited onboard recording. GPS devices, helmet cameras, or nearby traffic cameras might also hold valuable information about speed, movement, and any attempts to avoid leaving the roadway. Collecting that evidence promptly increases the chances it will be complete and reliable.
Determining what really happened means combining scene evidence, a detailed look at the motorcycle’s condition, and any available data so that no cause—mechanical or human—is left unexplored.
Takeaways:
- Detailed scene documentation is vital in single-motorcycle crashes.
- Mechanical inspections can uncover hidden issues that cause loss of control.
- GPS, camera, or limited onboard data can help reconstruct the final moments.
