Miguel Muro Ruvalcalba Killed in Work Accident in Prosper, TX

Commentary by Attorney Michael Grossman

Right now, OSHA statements show there were recommendations for fines totaling just over $6000. The alleged offenses listed in regards to those fines appear to concern proper securing of scaffolding as well as training in how “to recognize the hazards” of working on scaffolding and how to do so properly. I can’t offer any information that OSHA hasn’t already made public, but those seem to be serious accusations. Could it be that this terrible incident involved a shortcoming on the employer’s part? Was the worker not properly trained? Were they told to work on equipment that wasn’t properly secured? Does this employer show other signs of putting its workers at risk?

It goes without saying that mistakes can happen, and information could come to light here that just shows this all was a tragic accident. But information could also show that the victim would still be alive had they worked for a more responsible employer. I can only hope OSHA was more thorough in getting answers for the victim’s loved ones than they were in their public summaries.
