Commentary by Attorney Michael Grossman
When fatal accidents involve passenger vehicles and commercial trucks, a thorough investigation is essential to understand the circumstances and determine contributing factors. Drawing on my experience, finding answers requires focusing on three critical questions: Did authorities conduct a comprehensive investigation of the crash? Has anyone considered the possibility that a mechanical defect or maintenance issue contributed to the accident? And has all electronic data from the vehicles involved been collected and reviewed?
Initial reports suggest that a passenger vehicle veered left-of-center into the path of an oncoming 18-wheeler, resulting in a head-on collision. While this sequence of events may seem straightforward, it leaves many questions unanswered. Did investigators assess potential external factors such as road conditions, visibility, or traffic patterns? Did they examine whether the truck’s speed or position played a role in the collision? Comprehensive crash scene analysis is crucial to ensuring that no detail is overlooked.
Mechanical or vehicle-related issues must also be explored. If the passenger vehicle experienced a failure such as a tire blowout, brake malfunction, or steering defect, it could have caused the reported loss of control. Similarly, the 18-wheeler must be inspected for any mechanical or maintenance-related issues, including brake conditions or steering alignment, which could have influenced its ability to avoid the collision. Thorough vehicle inspections are necessary to identify potential contributing factors beyond driver behavior.
Finally, modern passenger vehicles and commercial trucks are often equipped with event data recorders (EDRs) that store information about speed, braking, and steering inputs in the moments before a crash. Accessing and analyzing this data can provide critical insights into what happened and why. Timely retrieval is essential to ensure that valuable evidence is preserved.
Accidents like this, where a woman lost her life, demand meticulous investigation to uncover every contributing factor. By addressing these questions, investigators can work to provide clarity and closure for the loved ones left behind. A thorough and impartial review of the evidence is the least that can be done to ensure all aspects of the incident are understood.
