Commentary by Attorney Michael Grossman

When families contact me following single-vehicle wrecks like this, they often have the same concern. How can they be sure authorities are fairly telling all side of the story and not just jumping to conclusions? In my experience, a prudent path forward is to ask key questions and see how authorities respond.

1. Did the authorities thoroughly investigate the crash?

In situations where a vehicle “lost control,” understanding why that happened takes more than just a quick look at the scene. Did investigators analyze the vehicle’s path, check for signs of over-correction, or look at road conditions and tire marks? Without a full reconstruction, the cause can easily remain unclear.

2. Has anyone looked into the possibility that a vehicle defect caused the crash?

When a truck suddenly veers off course, it’s worth considering whether something inside the vehicle failed. Issues with steering, suspension, or braking systems don’t always leave obvious evidence. Unless a qualified inspection was done, those possibilities could have been missed entirely.

3. Has all the electronic data relating to the crash been collected?

Modern vehicles, including pickups like the Dodge Ram, often store key data—vehicle speed, steering inputs, braking patterns, and more. Phones, GPS systems, or any dashcams may also hold useful context. That information is crucial in understanding what the driver was dealing with—if someone acted quickly enough to secure it.

Generally speaking, it authorities can provide clear, extensive answers, then it’s likely a sign they’re being thorough in their investigations. But if their answers instead leave doubts and concerns, that can be a family’s sign that the accident may need another set of eyes looking things over. That way, if anything important slipped through the cracks, it can be brought to light.

Takeaways:

  • It’s unknown whether investigators thoroughly reconstructed the crash to explain the loss of control.
  • A mechanical issue inside the vehicle may have contributed but won’t be found without inspection.
  • Vehicle and device data could offer critical insight—if it was gathered in time.
