Commentary by Attorney Michael Grossman

As straight-forward as this all seems, it’s important to understand that there really are no “simple” car accidents. They need to be carefully investigated to ensure the victims and families involved have all the evidence they need going forward. Here are three questions I always consider when a car accident comes across my desk:

  1. Were investigations prioritizes, or did authorities move on after looking only at surface details?
  2. Have the vehicles been inspects for potential defects with driving mechanisms or safety devices?
  3. Has electronic data been secured from the vehicles, cellphones, and any potential video cameras?

In my experience, authorities being able to provide satisfactory answers to these questions happens when their investigations are thorough. When their answers come up short, though, that can be a sign to get the crash in the hands of independent accident reconstructionists before something important slips through the cracks.
