Commentary by Attorney Michael Grossman

Over the years I’ve noticed that many people tend to write off accidents like this one, assuming that if the pedestrian wasn’t in a crosswalk then he was at fault. Things are rarely ever that simple, and the bare-bones story laid out in the news isn’t nearly enough to really explain what happened in Temple.

I don’t know about you, but I feel there are still a lot of questions here that urgently need answers: Where exactly was the victim on the exit ramp? Was he walking in the lane, or on the shoulder beyond the fog line? How visible should he have been to approaching vehicles? Was he dressed in dark or light clothing? Is there any nighttime lighting in that area? Where was he that night before his walk? And what about the vehicle that hit him—were its headlights on? Was the driver awake and alert? Did other drivers manage to avoid the pedestrian? Were there any witnesses? Did anyone gather electronic data from the vehicle and both parties’ cell phones?

That may sound like I’m just piling extra work onto something that might have a simple explanation, but that’s the thing: Nobody can be sure this is simple without first looking into possible complications, and that means finding clear evidence of what really happened. I think most would agree that the victim’s loved ones deserve no less than the whole story; will someone make sure they get it?
