Commentary by Attorney Michael Grossman

If it’s true that this involved an alleged drunk driver, it wouldn’t be unusual if charges were considered. But consequences may require investigations beyond a single driver’s actions. Here’s why.

Texas dram shop laws hold alcohol providers accountable if they serve alcohol to someone who is obviously intoxicated. If the alleged drunk driver was over two and a half times the legal limit, it’s worth asking whether an establishment continued serving them past the point of obvious impairment. If that happened, the alcohol provider may share responsibility for this crash.

Too often, drunk driving investigations stop at the driver, overlooking the role that an alcohol provider may have played. Rather than shifting blame, these laws help to ensure all parties involved in a serious accident face appropriate consequences. If authorities aren’t looking into things beyond the scene, that might not happen unless there are more thorough investigations.
