How Did This Accident Occur?
Generally speaking, the most common contributing factor in a pedestrian accident is failure to yield the right of way. That’s always an important possible factor to consider. However, it’s just one of many other possible factors that need attention.
For example, have investigators checked to see if the traffic signals at this intersection are working properly? If a driver or pedestrian sees a signal to go at the wrong time, both people could rightfully believe they have the right-of-way. This can obviously lead to serious accidents. It might seem unlikely, but I’ve seen stranger things happen throughout my decades-long career. At the very least, it’s something that needs careful consideration to either bring it to light or rule it out.
Maybe that isn’t what happened here, but it’s an example of why jumping to the most common explanation is dangerous. I’m sure plenty of folks can give examples from an accident they or a loved one were involved in where something highly unusual led to an accident.
