Commentary by Attorney Michael Grossman
If the allegations here are true, it’s good to see authorities take steps to make things right. But even if the charges against this alleged drunk driver go through, that may not be the end of the story. In my experience, there’s usually an accomplice to these accidents: a negligent alcohol provider.
Put simply, bars and other establishments in Texas can be responsible for contributing to serious drunk driving accidents. If evidence shows they over-served someone who was obviously intoxicated, they can be responsible when that intoxication leads to people getting hurt or killed.
Too often, though, authorities just move on once there’s a driver facing charges. Meanwhile, there could be a negligent alcohol provider continuing to put the the community in danger. That’s why accidents like this often need secondary investigations to make sure any accomplices to the accident also answer for their actions.
