Commentary by Attorney Michael Grossman
While folks tend to assume that authorities are a lot more thorough behind the scenes than they are in these public investigation summaries, that’s not always true. I’ve worked with many families who only ever knew the few details that were released to the public, and it took more thorough independent investigations to actually tell the whole story. This can obviously be detrimental to a family, especially in Texas, where work fatality laws are more complex than in any other state. Simply put, there isn’t always a guaranteed path for a family to reach a fair conclusion, and that can leave them fighting for that conclusion. This requires evidence and legal tools well beyond what a preliminary report is going to offer, which is why I’m skeptical that a preliminary report mentioning a few citations makes this situation open-and-shut like people might think .
