Lance McClain, Car Accident in Webster, TX

Investigators said that 38-year-old Lance McClain was in a northbound Ford F-150. At the crossing, it appears that a southbound Honda Civic disregarded the traffic signal, resulting in the two vehicles colliding. As a result, both McClain and the other driver had reportedly serious injuries.

Authorities say that the Honda driver had been drinking. However, they didn’t confirm charges or that alcohol was the cause of the crash.

Commentary by Attorney Michael Grossman

While alcohol isn’t a confirmed cause for the accident, it would certainly explain why someone might run a light. But even if it was the cause of the crash, that wouldn’t necessarily make things open-and-shut. People tend to think it’s just about charging the driver, and that’s that. However, there’s often an accomplice: a negligent alcohol provider.

Simply put, if a bar, restaurant, or similar venue over-serves someone who is obviously intoxicated, it exposes them to consequence. This can include criminal investigations, fines, suspended licenses, or liability for the victims’ injuries. Not only does this help to ensure there’s accountability for unlawful actions, it gets those establishments to clean up their act before more people can get hurt.

So while details aren’t yet confirmed here, there are more than enough red flags to warrant as thorough an investigation as possible into what all led up to the crash. It could be that even the steps authorities are taking right now aren’t telling the whole story.
