Authorities recommended a charge for intoxication assault. Given these allegations, if they’re true, did authorities find out where that alcohol came from? It wouldn’t surprise me if a local alcohol provider is also responsible for this accident. So many alcohol-related accidents happen around 2:00 a.m. because that’s when people are done drinking at bars. A lot of those bars simply ignore the law and continue serving people beyond when they’re obviously intoxicated. By holding them accountable through things like criminal investigations, fines, and civil liability for any resulting injuries, those alcohol providers can actually face consequences that get them to clean up their act.

Unfortunately, that’s not something authorities are generally motivated to do. I’ve had hundreds of cases against negligent alcohol providers. Our investigations for the purposes of a civil case are often the only investigations happening. That’s still effective in getting negligent alcohol providers to take responsibility for their actions, but it’s just one avenue Texas law provides to see appropriate consequences for accidents like this. It makes me think of all of the victims and families who never bothered reaching out to a professional because they assumed authorities were telling them the whole story.
