Commentary by Attorney Michael Grossman

After alleged drunk driver crashes like this, there’s often a question authorities fail to answer: Was the drunk driver over-served by a bar? As much as folks talk about the importance of holding people accountable for contributing to serious accidents like this, that rarely extends beyond the crash scene.

Texas law provides multiple avenues through which negligent alcohol providers can be held accountable if the unlawfully over-serve someone. This can include potential criminal investigations, fines, suspended licenses, and liability for injuries resulting from that intoxication. But I’ve handled hundreds of cases against negligent alcohol providers, and I rarely see authorities taking steps on their own to see bars and other establishments held accountable for their role in serious accidents.

It could be that investigations here would show authorities have already taken steps to ensure all parties responsible for the accident are going to answer for their mistakes. But if there’s an accomplice to this who has yet to be called out, it unfortunately wouldn’t be the first time.
