Commentary by Attorney Michael Grossman

Left-turn accidents like this one raise important questions about whether the turn was made safely and in accordance with traffic laws. While many assume that fault is clear in these situations, my experience handling similar cases has shown that a full investigation is needed to determine exactly what happened and why.

Did authorities conduct a thorough investigation into why the left turn was made at an unsafe time? While driver error is a common explanation, investigators should consider whether visibility issues, poor lighting, or other roadway conditions played a role. Were there obstructions that prevented the Dodge driver from seeing oncoming traffic? Was the intersection properly marked and illuminated?

Has anyone looked into potential vehicle issues that could have contributed? If the Dodge experienced brake failure or another mechanical issue, that could have prevented the driver from yielding in time. Similarly, the motorcycle’s speed and braking capability should be reviewed to determine if the rider had a fair chance to avoid the collision.

Has all available electronic and surveillance data been reviewed? Nearby security cameras, dashcams, or even vehicle data recorders could provide valuable insights into how the crash unfolded. Reviewing this data can help determine whether external factors, such as another vehicle obstructing the driver’s view or unexpected roadway conditions, played a role.

Accidents like this, where a motorcyclist suffered serious injuries due to a left-turn collision, demand a meticulous investigation to uncover all contributing factors. Addressing these questions helps ensure the incident is fully understood and provides the foundation for any necessary steps to ensure accountability. A thorough investigation is the least that can be done to provide clarity and closure for those affected.
