Commentary by Attorney Michael Grossman
When a truck rolls onto a person at a commercial site, the outcome raises immediate questions about how such an event could occur in the first place. Getting to the truth requires more than a surface review—it takes a close look at the vehicle, the environment, and the sequence of events leading up to the rollover.
Did the authorities thoroughly investigate the crash?
An incident like this should be treated with the same level of care as a roadway collision. Investigators need to map the truck’s position, determine how it began moving, and analyze whether it was parked, in operation, or undergoing maintenance at the time. Without that level of detail, the root cause may never be clear.
Has anyone looked into the possibility that a vehicle defect caused the crash?
A truck rolling unexpectedly can point to potential mechanical or safety failures. Parking brake malfunctions, transmission issues, or problems with the truck’s stability systems could all contribute. Unless the truck is thoroughly inspected, it’s impossible to rule out whether a defect or maintenance lapse allowed it to move when it should not have.
Has all the electronic data relating to the crash been collected?
Many commercial trucks are equipped with event data recorders that log vehicle activity, including movement, braking, and gear position. Reviewing that data could confirm whether the truck was secured or if it began moving suddenly. Nearby surveillance cameras at the site may also provide crucial context. Collecting this evidence quickly is critical to preserve accuracy.
Reaching a clear understanding requires combining mechanical inspection, digital records, and scene evidence so no possible factor is overlooked.
Takeaways:
- A rollover at a commercial site requires the same detailed reconstruction as a highway crash.
- Mechanical inspections can confirm or rule out brake, transmission, or stability failures.
- Electronic data and site cameras may provide the clearest account of how the truck moved.
