Commentary by Attorney Michael Grossman

Pedestrian accidents can often be more complex that people realize. As important as right-of-way is, it may just be one factor of many. There also has to be investigations into lighting, signage, road design, alcohol, distracted driving, speeding, etc. At the end of the day, if accident reconstructionists determine the accident was avoidable, there needs to be consideration for how it could have been avoided.
