Commentary by Attorney Michael Grossman

When accidents like this happen, it’s easy for people to assume they’re the result of bad timing or a momentary error. However, based on my experience, incidents involving large vehicles like dump trucks often involve multiple layers of complexity that need thorough investigation. This crash is no exception.

At this stage, we don’t know the specifics of how a dump truck came to overturn on top of a passenger vehicle, but questions about both driver actions and vehicle conditions are critical. Dump trucks are massive, heavily loaded vehicles that require careful handling, and any deviation from proper driving or vehicle maintenance can lead to catastrophic consequences. Was the driver of the dump truck distracted, fatigued, or speeding? Was the truck itself properly maintained, with brakes and other systems functioning as they should? Answering these questions will be key to understanding what caused the collision.

Additionally, it’s essential to examine whether the companies involved played a role. Trucking companies have a duty to ensure their vehicles are in safe working order and that their drivers are trained and prepared for the road. If the dump truck was poorly maintained or if the driver was not adequately trained or pressured by unrealistic schedules, the company may share responsibility for the crash. This makes it crucial for investigators to look beyond the immediate crash scene and delve into the company’s policies and the vehicle’s maintenance history.

Ultimately, the goal is to uncover the truth and provide answers to those affected by the crash. Even if it requires conducting an independent investigation to obtain vital evidence, it is crucial to consider every factor to ensure that those impacted by the crash receive the clarity and closure they deserve.
