El Paso, TX — April 18, 2024, Javier Resendiz and Javier Resendiz Jr. and two others were injured in an alleged drunk driver accident on McCombs Street.

Authorities said in preliminary statements that the accident occurred at around 7:00 p.m. at the intersection of McCombs Street and Sun Valley Drive.

According to officials, 59-year-old Javier Resendiz and 29-year-old Javier Resendiz Jr. were in a Nissan Frontier going southbound along McCombs. At Sun Valley, the Nissan was making a left turn. That’s when, according to police, a northbound Dodge Challenger crashed into the side of the Nissan.

As a result of the collision, Javier Sr. and a passenger in the Dodge had reportedly serious injuries. Javier Jr. and the driver of the Dodge reportedly had moderate injuries.

The driver of the Dodge was allegedly under the influence of alcohol at the time of the collision. If that’s true, where did that alcohol come from?

Here’s why that matters. When folks hear that a driver was drunk, all the focus tends to go to them. That’s understandable, but a lot of drunk driving wrecks involve people who were illegally over-served by a bar, restaurant, liquor store, or some other establishment. If they, too, break the law and get people hurt, shouldn’t they also be held accountable?

Texas law certainly says so. It’s just that authorities don’t often have the motivation to go after those alcohol providers like they do drunk drivers, who are typically right there are the scene and ready to be arrested. That’s why it usually takes more thorough independent investigations to actually look into these accidents and find out who all is responsible for the victims’ injuries. Otherwise, there could be an accomplice that slips through the cracks to continue putting lives at risk.
