Commentary by Attorney Michael Grossman
Crashes where a passenger vehicle collides with the back of a stopped or slow-moving truck raise serious concerns about visibility, following distance and whether the truck was properly marked. In this case, reports indicate that a Lincoln Navigator crashed into the back of a dump truck that was stopped in traffic on the Spaulding Turnpike, resulting in the death of the Lincoln driver. A full investigation should determine whether this was due to limited visibility or another contributing factor.
One of the first questions investigators should answer is whether the dump truck was properly visible to approaching drivers. Large trucks can be difficult to see in certain lighting conditions, and if the truck’s brake lights or hazard signals were not functioning properly, that could have reduced the Lincoln driver’s ability to recognize the stopped vehicle in time. Investigators should examine whether the truck had the required reflective markings and operational brake lights.
Road and traffic conditions should also be considered. Was this section of the highway congested, making it difficult for drivers to react to sudden stops? Was the road wet, icy or otherwise hazardous? If environmental factors played a role, those should be closely examined.
At this stage, there isn’t enough public information to determine exactly what led to this crash. But if authorities focus only on who hit whom without investigating why the Lincoln driver was unable to stop in time they risk missing key details. A thorough investigation should take all possible factors into account to ensure a full understanding of what went wrong.
