Garcia Sustaita sustained fatal injuries due to the accident. It’s unclear if anyone else was hurt. The OSHA summary listed four alleged violation recommended citations labeled as “serious.” No further information is available.

While I can’t confirm the initial details from the OSHA summary, folks may see the issued citations and assume that’s a sign OSHA has all of this taken care of. But Texas work fatality law is the most complex of any other state in the country. Unlike other states, employers in Texas are not required to subscribe to the workers’ comp system. That sometimes means families think they’re automatically entitled to benefits for the loss of their loved one but are actually on their own unless they seek out experienced allies who can navigate such a complex legal maze. That’s not the sort of thing OSHA alone tends to prioritize, so it’s highly unlikely their efforts were enough to address all of the challenges likely surrounding these events.
