Commentary by Attorney Michael Grossman
In all the chaos surrounding an accident like this, it’s easy to lose sight of the fact there still needs to be a proper, thorough accident reconstruction. After any serious crash, I always ask three key questions:
1. Did investigators fully reconstruct the crash?
I’ve seen too many situations where a chaotic crash and intense rescue efforts cause investigations to take a back seat. This can result in investigations that focus too much on the obvious while letting other possible contributing factors slip through the cracks. It’s best that investigations cover all possibilities, even if they may seem less likely.
2. Was the vehicle checked for mechanical issues or defects?
Even when other factors are involved, possible vehicle defects should be considered. There’s no telling when things like lane assistance, automatic braking, airbags, seatbelts, or even the structural integrity of the vehicle itself might cause a moderate crash to become far more severe.
3. Was the vehicle’s electronic data preserved?
The car’s onboard computer may contain crucial information like speed, brake use, and steering inputs in the moments before the crash. Cellphone and video camera data can also be time-sensitive and needs to be preserved promptly.
These questions are essential not just for finding answers, but for ensuring the victim’s side of the story isn’t left out of the official record. Whether or not those steps are being taken here remains to be seen.
