Commentary by Attorney Michael Grossman

If the allegations here are true, then authorities are clearly taking steps to see there are consequences for what happened. But in a lot of drunk driving accidents, the wrongs that need to be righted don’t always begin and end at the crash scene. Often, there is an accomplice who needs to answer for their actions: a negligent alcohol provider.

In Texas, bars and other alcohol providers who over-serve obviously intoxicated customers can be responsible when that intoxication leads to people being hurt or killed. Our state recognizes the danger alcohol can pose when handled irresponsibly—by drivers and providers alike. So, if an establishment ignores the law and continues to serve someone who’s a clear danger to the public, they can face consequences for what that over-service leads to.

That’s why I have to wonder if authorities gave this accident the attention it deserves. I’ve handled hundreds of cases involving alcohol, and I rarely see authorities look into where the alcohol came from. Once there’s a driver facing charges, their efforts typically end there. Meanwhile, there could be a negligent alcohol provider who played a role in a family losing their loved one. That sort of behavior cannot go unchecked. That’s especially true when a complicit negligent alcohol provider may continue putting the community at risk.
