Commentary by Attorney Michael Grossman
If it’s true that alcohol led to this crash, people might think that charges against the alleged drunk driver would be the beginning and end of the story. In Texas, though, alcohol providers are often responsible for contributing to serious accidents, as well.
Simply put, if a bar, restaurant, or similar venue over-serves someone that is obviously intoxicated, the establishment can be held accountable when that intoxication leads to harm. Not only is this an avenue for victims and families to see consequences for those who wronged them, but it’s also a path to get those negligent alcohol providers to clean up their act before more people get hurt.
Too often, though, negligent alcohol providers fly under the radar. I’ve handled hundreds of alcohol-related accident cases, and authorities tend to focus all of their efforts on the drunk drivers. As such, it might take more thorough independent investigations to find out what all led to this crash and who all needs to face consequences.
