Commentary by Attorney Michael Grossman

When people hear about accidents like this one, it’s common for them to assume it’s a simple case of driver error. However, in my experience, incidents involving large trucks are often more complex and require thorough investigations to understand all contributing factors.

One of the first aspects to examine is why the 18-wheeler attempted to pass in a no-passing zone. Was the driver impatient, unaware of the road markings, or trying to meet a tight schedule? Gathering data from the truck’s event recorder, reviewing traffic camera footage, and analyzing witness statements can help piece together the moments leading up to the crash.

Another critical factor is the role of the trucking company. Did they ensure that the driver was properly trained and adhering to safety protocols? Trucking companies are responsible for preparing their drivers for the challenges of the road. If the company failed in providing adequate training or pressured the driver to meet unrealistic deadlines, they might share responsibility for the incident.

Additionally, it’s essential to consider the condition of the 18-wheeler. Regular maintenance is crucial to ensure the vehicle operates safely. Any lapses in this can lead to mechanical failures that might contribute to accidents. Inspecting the truck’s maintenance records can reveal whether such issues played a role in this collision.

Ultimately, the goal is to uncover the truth and provide answers to those affected by the crash. Even if it requires conducting an independent investigation to obtain vital evidence, it is crucial to consider every factor to ensure that those impacted by the accident receive the clarity and closure they deserve.
