Commentary by Attorney Michael Grossman
When accidents like this occur, it’s easy to assume they stem from driver error or a brief lapse in judgment. However, in my experience, crashes involving passenger vehicles and large trucks on high-speed interstates like I-20 often reveal additional factors that require careful investigation.
One question worth examining is how visible each vehicle was to the other at the time of the crash. Trucks and SUVs typically have very different blind spots and visibility needs, and a large vehicle like an 18-wheeler may struggle to spot a smaller vehicle in certain areas around it. Additionally, if the truck was merging, changing lanes, or attempting a maneuver while obscured by low lighting or other visibility issues, this could have reduced the time available for either driver to react appropriately. Investigators should also consider whether reflective equipment on either vehicle was sufficient to make them visible to one another under the given conditions.
Beyond these potential visibility issues, it’s essential to look into whether the truck’s mechanical condition met all required safety standards. Trucks are subject to rigorous maintenance schedules, and equipment like lights, brakes, and steering must be in optimal working condition. Any mechanical shortcomings could have compromised the driver’s ability to control or stop the truck in time. By reviewing maintenance records and conducting a thorough inspection of the truck itself, investigators can determine whether any mechanical issues played a role.
Finally, it’s important to scrutinize the trucking company’s policies and protocols. If the truck driver was on a tight schedule or expected to meet stringent deadlines, it’s possible that the company’s policies may have put added pressure on the driver, influencing their behavior on the road. Such practices, if found, could indicate a shared responsibility on the part of the trucking company, which has a duty to prioritize safety over tight delivery schedules.
Ultimately, the goal is to uncover the truth and provide answers to those affected by the accident. Even if it requires conducting an independent investigation to obtain critical evidence, it’s essential to consider every factor to ensure that those impacted by the accident receive the clarity and closure they deserve.
