Hays County, TX — March 18, 2025, Flavia Gomez was killed in an alleged drunk driver accident at about 2 a.m. on southbound Interstate 35.

Authorities said a 2003 Chevrolet Silverado was stopped on the shoulder near Yarrington Road to deal with a loose tarp when it was hit by a 2015 Kia Cadenza.

The driver of the stopped vehicle, Flavia Arzate Gomez, 50, was pronounced dead at the scene of the crash near Kyle, according to authorities.

The other driver, who showed signs of impairment, was arrested after she admitted she had been drinking in Austin before the crash, authorities said. She has been charged with intoxication manslaughter.

Authorities have not released any additional information about the Hays County crash at this time. The accident is still under investigation.

When a driver admits to drinking before causing a fatal crash, it raises an important question: Where were they drinking, and was an alcohol provider involved?

Texas law makes it clear that bars and restaurants are not allowed to serve alcohol to someone who is already obviously intoxicated. If an establishment in Austin continued serving this driver past that point, they may share responsibility for what happened.

Dram shop laws exist to hold negligent alcohol providers accountable and to promote safer alcohol service. A thorough investigation should determine whether a bar or restaurant contributed to this crash by overserving the driver. Ensuring accountability isn’t just about this case: it’s about preventing future drunk driving tragedies by making sure alcohol providers follow the law.
