Commentary by Attorney Michael Grossman

I certainly don’t know more about this crash than what’s been released to the public. However, I’ve handled hundreds of commercial vehicle accident cases, and it’s important to highlight some of the common challenges that don’t often get talked about. For example, it’s important to know how thorough the authorities were in their investigations. They’re not always as reliable as people may assume.

Simply put, different departments have different levels of capability when it comes to investigations a complex commercial truck wreck. If authorities lack proper resources, if they aren’t trained for complex accident reconstructions, or if they’re rushed to move on to other responsibilities too quickly, important details can easily slip through the cracks.

One relatively simple solution for this is to ask authorities questions. Did they laser map the scene? Did they pull vehicle data? Have they secured cell phone records, did they inspect the vehicles for possible defects? Is there video of the crash? Did they speak with everyone involved in the wreck? If authorities can provide satisfactory answers, then it’s likely they did good investigations. But if they leave doubts and fail to address a family’s concerns, then it may be best that the crash gets a second look to make sure all the facts are brought to light.
