Commentary by Attorney Michael Grossman

Additional details aren’t clear right now, but things may seem open-and-shut. If one person has a stop sign, and the other doesn’t, it’s clear who’s at fault, right? Well, that’s not really how things work. In fact, this crash involving a motorcyclist can complicate things even further.

Simply put, a lot of people are biased against motorcyclists. If they’re told a rider did something wrong, they may not question it because they already figure motorcyclists are reckless despite many being safe drivers. I’ve even had cases where authorities filed completely inaccurate reports because someone falsely blamed a motorcyclist for a crash, and further investigations found evidence which completely contradicted the official account.

To be clear, I can’t say one way or the other what happened here. My point is that when it comes to motorcycle wrecks, there are inherent challenges that require close attention. If investigations aren’t thorough enough to ensure the evidence speaks for itself, something important may slip through the cracks.
