Commentary by Attorney Michael Grossman
The first question that comes to mind after reading about this crash is whether the truck driver should have been on the road in the first place. The driver’s arrest for driving under the influence and operating without a valid license raises immediate and serious concerns about the circumstances that led to this collision.
One of the fundamental responsibilities of trucking companies is ensuring their drivers are qualified and safe to operate such large and potentially dangerous vehicles. It’s crucial to investigate how someone without a valid license and allegedly under the influence was driving this truck. Did the trucking company fail to vet its drivers properly, or was this driver operating independently without oversight? Either way, these questions point to possible failures that may go beyond just one person’s actions.
The condition of the semi-truck and its trailer also warrants scrutiny. Sometimes, one serious mistake can be a red flag to look for others. That’s why it would be fair to ask whether the truck was properly maintained or if there were mechanical issues that contributed to the crash. Was the trailer visible and properly lit at the time of the collision? A trailer that isn’t adequately marked or illuminated can be nearly impossible for other drivers to see, particularly at dawn when light levels can be tricky.
The bottom line is this: Investigators need to dig deep into how this all happened. Some details may seem more significant than others, but the reality is they all need to be considered thoroughly. Only by understanding the full scope of what went wrong can the victim’s loved ones be certain they’re getting the whole story.
