Commentary by Attorney Michael Grossman
A lot of people write off accidents like this and just assume OSHA is going to handle everything. As many families I’ve worked with in the past would tell you, that’s not often how things go. OSHA has their own priorities, and they don’t always align with the needs of a family.
This can create significant challenges, as Texas has the most complex work fatality laws of any other state in the country. There isn’t always a guaranteed path for getting a family much needed benefits, so that burden may fall to them to seek out. That path is best navigated with the right legal tools and allies, and OSHA isn’t going to provide that. Since it’s still so soon after this accident happened, it’s prudent steps are taken early on to ensure the worker’s loved ones know their rights and how to best use them to get a resolution that’s right for them.
