Commentary by Attorney Michael Grossman
I’ve been working with families affected by deadly car accidents for over 30 years now. To this day, one of the most common concerns folks have—rightfully so—is they want to be sure the victim’s side of the story is being told fairly. Rarely is that concern more appropriate than after a single-vehicle crash. Let me explain.
Unfortunately, authorities don’t always prioritize accident reconstruction. This can lead to officers not being given the time or the tools they need to actually do a proper investigation. That’s when important details can start to slip through the cracks. So when it comes to a family looking for answers after a crash like this, one of the most prudent steps they can take is to follow up with the authorities and ask questions.
Have authorities looked for nearby cameras? Have they secured phone records? Did they pull data from the Engine Control Module (ECM)? Have they inspected the vehicle for possible defects? Are there any signs another driver was involved but fled the scene? Have they looked at the history of this intersection to find out if it’s a known dangerous intersection?
At the end of the day, it’s not about what is or isn’t likely. It’s about gathering clear evidence and letting the facts speak for themselves. If authorities can show they’re doing that, it can be a significant weight off the family’s shoulders. But if their answers fall short, that can be a family’s opportunity to put the crash in the hands of more thorough independent investigators.
