UPDATE (December 5, 2023): In more recent statements, authorities allege the driver who crashed with Devin Wold, resulting in Wold’s death, is facing charges for intoxication manslaughter.

Commentary by Attorney Michael Grossman

If those allegations are true, it’s unfortunately an all too common scenario. What remains to be seen, though, is if authorities believe alcohol was the contributing factor here.

Just about every wrongful death case I’ve handled involving a wrong-way driver also involved claims against a bar or a similar establishment who had over-served that driver. Just before midnight is a prime time for drunk drivers on their way home after a night out, and if they’re so unaware of their surroundings that they drive on the wrong side of the road long enough to hit someone, it often turns out they were illegally over-served. As a result, there is often charges not only for the drunk drivers but also for the bartenders who contributed to the crash.

Harris County tends to be more thorough than other counties when it comes to intoxicated driving accidents and the potential accomplices in the community that contribute to them. But right now, details are limited, and it remains unconfirmed if alcohol was even a factor here (as opposed to drugs, for example). Hopefully steps are being taken not to just file charges and move on but rather to ensure the victim’s loved ones know there’s going to be full accountability for their loss.
