Commentary by Attorney Michael Grossman
While details aren’t confirmed, it would be unusual if there wasn’t an intoxicated driver involved here. It’s almost always the reason someone gets on the wrong side of a divided roadway. But as open-and-shut as that may sound, there could be more to this situation that even authorities haven’t addressed. If the wrong-way driver was coming from a local bar, did the bar unlawfully over-serve them?
Simply put, alcohol providers in Texas unlawfully over-serve people if they provide alcohol to someone who is obviously intoxicated. This can expose them to potential criminal investigations, fines, suspended licenses, or liability for injuries resulting from the intoxication. Not only does this provide a path to see those alcohol providers held accountable, it can help put them on the straight-and-narrow so they don’t continue putting lives at risk.
Ultimately, authorities may have already investigated these possibilities, and maybe there was just an individual drunk driver involved in this accident. However, I’ve handled countless cases where authorities initially overlooked a negligent alcohol provider until our independent investigations brought them to light. Would secondary investigations here yield similar results?
