Commentary by Attorney Michael Grossman
If the allegations here are true, then the alleged drunk driver will no doubt answer for their actions here. But are they the only ones who contributed to the crash? Anytime drunk driving leads to a crash, it’s important to find out if that driver was unlawfully over-served by an alcohol provider. Let me explain.
In Texas, it’s unlawful for bars, restaurants, and other establishments to serve someone who is obviously intoxicated. If they do so, and that leads to people being hurt or killed, the alcohol provider can be held responsible for that.
I’ve handled hundreds of cases against negligent alcohol providers, and frankly, that’s not something authorities tend to look into on their own. They usually charge the drivers and consider the matter closed. But if a negligent alcohol provider is out there over-serving people, they’re likely to continue putting lives at risk until someone holds them accountable.
So, if this all was just due to one driver’s reckless decisions, charges against them may be the beginning and end of the story. However, in the more likely event they had help getting to that point of intoxication, there may need to be more thorough investigations to truly see accountability for the accident.
