Commentary by Attorney Michael Grossman

When accidents like this happen, it’s easy for people to assume they’re simply the result of a brief lapse in judgment or unfortunate timing. However, in my experience, crashes involving large trucks often require careful investigation to determine all the contributing factors.

In this case, the core issue investigators need to address is why the 18-wheeler driver attempted to pass the delivery truck as it prepared to turn. Passing can be risky even in optimal conditions, but the risks are magnified when a truck driver misjudges timing or distance, particularly when following another large vehicle. Key aspects for investigators to consider include whether the driver of the 18-wheeler was distracted, misjudged the speed of the delivery truck, or simply tried to pass without fully assessing the circumstances. Additionally, investigators may examine factors like visibility, road layout, and whether either driver signaled or checked thoroughly before making their maneuvers.

If the 18-wheeler was operating under a commercial company, it’s essential to assess whether the company’s training and safety protocols properly prepared the driver for making safe decisions in traffic. Companies bear responsibility for equipping drivers with the skills to assess passing opportunities safely and to avoid unnecessary risks. Any oversight in these areas could suggest shared responsibility for the crash.

Ultimately, the goal is to uncover the truth and provide answers to those affected by the accident. Even if it requires conducting an independent investigation to obtain critical evidence, it’s essential to consider every factor to ensure those impacted by the accident receive the clarity and closure they deserve.
