Commentary by Attorney Michael Grossman

If the claims here are accurate, people might see all of this as open-and-shut. A truck driver was going at unsafe speeds, and a crash occurred. What more is there to discuss? Well, it’s important to know why that happened. Answering that can lead to a whole chain of events that need more than just a simple citation.

I’ve handled hundreds of commercial vehicle accident cases. A lot of the time, a truck driver’s mistake is not isolated. It’s often the result of an employer who either encourages or allows reckless behavior.

For example, I had a case a while back where a negligent truck driver caused a serious crash. When we dug into the driver’s logs and the company’s practices, we found out the company was pressuring drivers to meet ludicrous deadlines. To meet these deadlines, drivers had to violate hours of service limits, speed, rush to beat lights, make dangerous u-turns, and otherwise cut every corner possible to save time. The drivers who did so got more work. The drivers who took the time to actually be safe were punished.

In an environment like that, a crash is all but inevitable. Addressing that root cause doesn’t excuse a truck driver’s actions. Rather, it recognizes that accountability has to extend to all wrongdoers who contributed to the accident. That’s especially true if doing so could help prevent others from being harmed in the future.

So while it may seem like authorities have taken some steps to address a mistake, a possible citation isn’t likely the end of the story.
