Commentary by Attorney Michael Grossman

When I read about a crash like this, my first thought is that I hope the injured driver and his family get the answers they deserve. A single-vehicle crash that results in a rollover raises immediate questions about what exactly caused the vehicle to lose control. It’s common for people to assume that these types of crashes are the result of driver error, but in my experience, the truth is often more complex. To fully understand what happened on U.S. Route 90 Alternate, we need to ask three critical questions.

First, did the authorities thoroughly investigate the crash? A thorough investigation of a rollover should go beyond basic documentation. Did investigators evaluate whether the road surface was slick, uneven or poorly lit? Was the median barrier designed in a way that contributed to the vehicle overturning? Did officials look for signs of evasive action or mechanical failure? In late-night crashes like this, where visibility is limited and traffic is lighter, it’s especially important to rule out contributing factors that may not be immediately obvious.

Second, has anyone looked into whether a vehicle defect played a role in the crash? Rollover incidents often involve questions about vehicle stability, tire integrity, steering systems or brake performance. The only way to assess these possibilities is to preserve the vehicle and have it examined by qualified experts. Unfortunately, this step is often missed if the vehicle is quickly repaired, scrapped or written off. Especially in cases involving serious injury, failing to explore a mechanical or design failure leaves a major gap in the investigation.

Finally, has all the electronic data related to the crash been collected? Modern vehicles are equipped with engine control modules that record key data leading up to a crash: speed, braking, throttle position and steering inputs. This information can help reconstruct the event with far greater accuracy than eyewitness recollection or physical evidence alone. If available, nearby traffic cameras or surveillance footage may offer additional context. But like all digital evidence, this information must be preserved quickly before it is overwritten or lost.

Crashes like this demand a careful and comprehensive investigation. A driver was seriously injured, and the assumption that a crash was simply a matter of personal error does a disservice to the truth. By asking the right questions, preserving the available evidence, and exploring every possible cause, the community gives those affected the opportunity to understand what really happened, and to move forward with the clarity they deserve.
