Commentary by Attorney Michael Grossman

It’s not unusual for there to be so few details available this soon after a serious workplace accident. Hopefully as investigations continue, the victims and families involved are able to be clued in to all the details rather than having to wait around for months without answers. They need as much information as soon as possible so they can navigate what could be an incredibly challenging legal maze.

Simply put, Texas has the most complex work accident laws of any other state in the country. There is not always a guaranteed path for getting people benefits, as many believe. Not all employers subscribe to the workers’ comp system, meaning it may be up to the families to pursue their own benefits, which employers are not often motivated to provide. Alternatively, even if the accident is covered by workers’ comp benefits, some accidents happen due to such extreme negligence that employers are subject to consequences beyond the typical confines of workers’ comp.

In order to deal with these hurdles, victims and families generally need all the evidence they can get as well as legal tools and strategies that can use that evidence effectively. Texas work accident law may be complex, but families can still take steps to ensure they reach a conclusion that’s fair to their needs. So as investigations into this accident continue, it’s important to keep in mind that knowing what happened and why is only the beginning. It’s also important to understand what comes next for those affected by the accident.
