Commentary by Attorney Michael Grossman

When it comes to pedestrian accidents, people sometimes are too quick to assume things are open-and-shut. Things aren’t always as simple as just finding out who had the right-of-way. For that reason, it can be important to consider a few key factors that aren’t always a focal point in typical police investigations.

For example, have authorities examined the lighting and signage in the area? Have they checked nearby businesses or residences for security video? Have authorities pulled and preserved cell phone data from the driver? Did they consider alcohol as a possibility? Do pedestrian accidents happen often on this stretch of road? Were there any witnesses who haven’t been interviewed?

Likely or not, these are the kinds of factors I’d expect to see addressed in a thorough, independent accident reconstruction. Sometimes, authorities ask similar questions and are able to provide satisfactory answers for a victim’s loved ones. Other times, though, their answers don’t add up or fail to adequately address a family’s concerns. That’s when it becomes apparent that an accident may need a second set of eyes to ensure nothing important slipped through the cracks.
