Commentary by Attorney Michael Grossman

With authorities saying a truck driver failed to yield here, that makes things seem open-and-shut. However, the reality is that no truck accidents are as straight-forward as people may think. Even if a truck driver makes an obvious mistake, it’s important to know why that mistake happened. In my experience, the answer is often that there were problems behind the scenes that need to be addressed.

For example, I handled a case a while back where a truck driver was being reckless trying to make time on a delivery. As we dug into the driver’s employer, we found a whole work culture that encouraged reckless driving and punished safe driving.

Essentially, the company expected drivers to cut corners and do as much work in as little time as possible—safety be damned. The drivers who actually took the time to drive responsibly were passed over when new jobs came in. The drivers who took risks and drove recklessly to cut time got more work. In other words, drivers had a choice: Be a safe driver or put food on their family’s table. It was inevitable that this would end in a catastrophic accident.

That sort of behavior is unfortunately common. Now, it’s possible the driver here really just had a lapse in judgement, and evidence will show there isn’t additional danger to the public. But if investigations address this driver’s actions alone without looking into their hours of service, pulling cellphone data, checking maintenance records, getting driver history and training records, and otherwise analyzing what’s going on behind the scenes, there may be accomplices to this crash who get to ride off into the sunset without so much as a slap on the wrist. With serious injuries and a kid hurt in this crash, that simply wouldn’t be right.
