Commentary by Attorney Michael Grossman

When a crash results in a fatality, people often assume authorities will conduct an in-depth investigation to determine exactly what happened. However, in my experience, that isn’t always the case. Law enforcement agencies have many responsibilities, and sometimes accident investigations don’t get the attention they truly need. That’s why it can be important for victims’ families to follow up with key questions.

For example, have authorities conducted a full reconstruction of the crash? Determining things like vehicle speeds, visibility conditions, and possible right-of-way violations can be crucial in understanding how the wreck happened. If authorities don’t take the time to gather this data, important details could be overlooked.

Did investigators take the time to rule out any vehicle defects that may have contributed to the crash? Even a well-maintained vehicle can experience failures with brakes, steering, or other critical systems. It’s important that authorities consider whether vehicle performance played a role rather than assuming driver error was the only factor.

Finally, are investigators collecting all available electronic evidence? Surveillance cameras, traffic cameras, and even vehicle data recorders may have captured information that could clarify what happened. Cellphone records could also help determine if distractions played a role. If authorities don’t secure this data quickly, it may be lost.

If authorities show they’re looking into these crucial details, then they’re likely doing good, thorough investigations. However, if they come up short and leave doubts, a victim’s family may decide it’s time to have a second set of eyes look things over so nothing important slips through the cracks.
