Commentary by Attorney Michael Grossman
When accidents like this happen, many people might assume they result from simple errors, such as running a red light. However, based on my experience, accidents involving large trucks often involve deeper, more complex factors that require careful investigation.
In this case, the truck’s failure to stop for the traffic signal is concerning, but the reasons behind this failure are just as important. Investigators will need to determine whether the truck driver was distracted, fatigued, or facing any mechanical issues that could have contributed to the crash. The possibility of brake failure or other malfunctions should also be explored, as these are not uncommon in heavy commercial vehicles if proper maintenance is neglected.
Additionally, it’s crucial to consider the truck’s compliance with traffic regulations and whether the driver was operating under safe conditions. If the truck was part of a commercial fleet, the trucking company’s role in maintaining the vehicle and ensuring the driver was properly trained and rested must also be examined. If any lapses in these areas are found, the company could share responsibility for the accident.
Ultimately, the goal is to uncover the truth and provide answers to those affected by the crash. Even if it requires conducting an independent investigation to obtain vital evidence, it is crucial to consider every factor to ensure that those impacted by the crash receive the clarity and closure they deserve.
