Commentary by Attorney Michael Grossman

Generally speaking, people tend to assume these kinds of accidents are straightforward or simple. Authorities sometimes do the same thing, and that’s when mistakes happen. For example, I had a case recently where a family was worried authorities mishandled their investigations. Authorities blamed the victim for not wearing his seatbelt, but that was behavior the family never knew the man to engage in.

Thanks to more thorough independent investigations, we found out that the victim’s seatbelt had a defect. They’d been wearing it properly, but the defect led to the seatbelt coming loose and failing to properly protect the victim. Had it not been for the family trusting their gut and looking for a second opinion, there’s no telling if that ever would have come to light. Maybe nothing so unusual happened here, but if investigations don’t consider such possibilities, they’re bound to miss something.
