Commentary by Attorney Michael Grossman

When I read about a crash like this, my first thought is that I hope investigators take the time to determine exactly what happened. A crash involving a pedestrian and a vehicle that was initially stopped raises a number of important questions, and experience has shown me that these incidents can be more complex than they first appear. That’s why any thorough investigation must address three critical questions.

First, did the authorities conduct a thorough investigation? The report states that the pedestrian approached the Toyota Corolla before being struck as the vehicle drove away, but it’s unclear what led up to that moment. Did the driver intend to leave abruptly, or did they not realize the pedestrian was near the vehicle? Were there any witnesses who could provide additional context? Additionally, investigators should review lighting and visibility conditions on Goforth Road: was the area well-lit enough for both the pedestrian and driver to see each other clearly? Without these answers, crucial details could be missed.

Second, has anyone considered whether a vehicle defect played a role? While many assume pedestrian crashes are the result of driver error or poor visibility, mechanical failures should always be examined. Did the Toyota Corolla have any issues with acceleration, braking or transmission control that could have caused the driver to unintentionally lurch forward? Modern vehicles also come equipped with pedestrian detection and automatic braking systems: did those systems fail to engage? Unless the vehicle is preserved and examined, these possibilities may never be explored.

Lastly, has all the electronic data from the crash been preserved? The 2016 Toyota Corolla is equipped with an engine control module that records important data, including speed, braking and acceleration. This information could clarify whether the driver intentionally accelerated or if the car moved unexpectedly. Additionally, any nearby security or traffic cameras may provide visual evidence of the crash, and cell phone records could help determine whether distractions played a role. However, if this data isn’t secured quickly, it could be lost, making it much harder to piece together the events leading to the crash.

At the end of the day, pedestrian-involved crashes require a thorough investigation to ensure all possible factors are considered. Those affected deserve clear answers, and the only way to provide those answers is by exploring all avenues, including mechanical issues and electronic data. The least the community can do is ensure that every effort is made to determine exactly what happened.
