Commentary by Attorney Michael Grossman
When two vehicles collide head-on, the investigation often has to answer questions that go far beyond the point of impact. Determining why a vehicle crossed into opposing traffic can be one of the most challenging parts of the process.
1. Did the authorities thoroughly investigate the crash?
A full inquiry would mean more than documenting the collision site—it would involve mapping the roadway with precision tools, examining tire marks to understand avoidance attempts, and gathering witness accounts. Understanding the Ford’s position and movement before the impact is essential to figuring out what went wrong.
2. Has anyone looked into the possibility that a vehicle defect caused the crash?
While driver error is sometimes assumed in lane-crossing incidents, a mechanical failure—such as steering issues, brake problems, or a tire blowout—could also push a vehicle into oncoming traffic. Inspecting both vehicles, particularly the Ford, for any sudden component failures is an important step.
3. Has all the electronic data relating to the crash been collected?
The Ford’s event data recorder could hold vital information on speed, steering inputs, and brake use before the crash. Data from the Dodge could also confirm its speed and driver reactions. Traffic camera footage or dashcam recordings, if available, would help piece together the sequence of events.
The clearest picture of what happened comes when investigators pursue every lead—mechanical, behavioral, and digital—rather than stopping at the most visible explanation.
Takeaways:
- Mapping the scene and reviewing tire mark evidence helps confirm vehicle movements.
- Mechanical inspections can reveal failures that might cause a lane departure.
- Event data recorders from both vehicles can provide a precise timeline of actions.
